St. Louis Woman Killed by City Bus, Wrongful Death Suit Pending

031011 stl city bus.jpg

St. Louis woman was struck by a city bus while crossing the street, ultimately leading to her death.

On February 3, 2011, Rosalind D. Smith of the 1600 block of Grape Aveune, was attempting to cross DeBaliviere Aveneue near Forest Park Parkway. At that time and place, Smith was hit by a city bus traveling on DeBaliviere Avenue. Police believe she was crossing the street when she was struck. Smith was rushed to an area hospital where she died soon after the crash.

Following Smith's death, her sister Deborah Smith, has filed a wrongful death suit against Bi-State Development Agency. The two sisters lived together, were not married and were without children. The suit, filed in St. Louis Circuit Court, alleges that the unnamed driver failed to keep a careful lookout, did not properly use mirrors, knew or should have known that Rosalind Smith was there, and failed to warn her not to stand or walk in front of the bus. Deborah Smith is seeking unspecified damages.

A Metro spokeswoman said that the agency does not comment on pending lawsuits. At the time of the crash, Metro stated that the bus driver faces termination due to an agency policy of firing any driver involved in a fatal crash. However, the process gives employees the right to appeal.

Metro spokeswoman Patti Beck could not comment on the driver's job status stating it was a personnel matter. However she did disclose that any action against the bus driver is pending the result of the accident investigation by Metro and police.

The driver, age 62, had worked for Metro since 1988 and his record showed only one minor crash with a car in 2007.
