Wrongful Death Suit Filed in St. Louis County Against Drunk Driver

Berkeley man was killed in a car crash resulting from a drunk driver, wrongful death lawsuit to follow.

On June 26 at approximately 3:40 a.m., 33 year old Alfredo Olvera-Ramirez of the 200 block of Palm Drive in Hazelwood, was driving on Berkeley Avenue at James S. McDonnell Boulevard. At that time, 29 year old Demarcus Upchurch of University City was operating his vehicle at the same location. Ramirez then crossed over the center line and hit Upchurch’s vehicle. Demarcus Upchurch was killed in the crash.

A blood test following the crash showed Ramirez had a blood alcohol content of .11, significantly higher than the legal limit of .08. The mother of Upchurch’s child has filed a wrongful death suit in St. Louis County against Ramirez on behalf of their six year old son. The wrongful death suit also names American Family Insurance Company for allegedly refusing her son a “reasonable amount of benefits” for an uninsured motorist claim.

Ramirez was charged with involuntary manslaughter in St. Louis County in July 2011 for causing the crash that led to the death of Upchurch. Ramirez is currently being held in the St. Louis County Jail on a $50,000 bond.
