Driver Killed in Wrongful Death Crash

In Polk County, the driver of one vehicle is killed after the at-fault driver crossed the oncoming lanes of traffic and pulled into the path of the driver.

On March 12, 2013 at approximately 11:42 a.m., Ralph Williams, age 79 from Flemington, Missouri was operating a 1999 GMC Van. Mary Schwartz, age 36 from Flemington, Missouri was the only passenger in Ralph’s vehicle. Roye Swank, age 86 from Ottawa, Kansas was operating a 1999 Chevrolet pickup truck. Ramah Swank, age 82 from Ottawa, Kansas was the only passenger in Roye’s vehicle during the time of the crash.

At that said date and time, Roye Swank was traveling in the southbound direction as Ralph was traveling in the westbound direction on Highway 13 in Humansville. The collision occurred as Ralph attempted to cross the southbound lanes of Highway 13, failed to yield, and pulled into the path of Roye’s vehicle. Ralph collided with Roye’s vehicle broadside.

Ramah Swank was pronounced dead by the Polk County Coroner, Roy Harms, who responded to the scene of the crash. Ramah’s body was taken to Murray Funeral Home in Humasville. Roye Swank received serious injuries and was taken to Cox South Hospital in Springfield. Mary Schwartz was seriously injured from the collision and was transported to Cox South Hospital. Ralph Williams also received serious injuries and was taken to Citizens Memorial Hospital in Bolivar.

According to the crash report from the Missouri State Highway Patrol, Roye Swank and Mary Schwartz were not wearing their seat belts during the collision.

Ralph’s 1999 GMC Van received total damages and was towed by B & B Wrecker of Bolivar. Roye’s 1999 Chevrolet received total damages and was towed by Wakefield Towing of Bolivar.

This fatality crash was investigated by the Missouri State Highway Patrol and with the assistance of Troop D. This is Troop D’s 19th fatality for 2013.
